Terms of Use – Studio Flergs

PERSONAL USE:

These terms of use apply to personal use items purchased at Sweet Shoppe Designs HERE

Studio Flergs retains and reserves the right to modify, update and change the Terms of Use for all digital designs at anytime with or without notice. It is your responsibility to check for updates and changes to the Terms of Use.

Unless stated elsewhere, any amendments to this Terms of Use agreement will take effect 10 business days from the time it is posted.

Due to the constantly changing nature and growth of the online world, and the vast array of money making opportunities available on the internet, Sweet Shoppe Designs & Studio Flergs products are no longer Scrap 4 Hire / Scrap 4 Others (S4H/S4O) friendly and permission must be requested for ANY commercial use enterprise. My terms apply to all eligible products currently for sale by Studio Flergs. In short…

YOU MAY Use my designs for your own personal scrapbook pages and projects, including hybrid works or paper scrapping.
YOU MAY Use my designs in layouts that are posted in online galleries and/or submitted to magazines. Please be sure to credit Studio Flergs with the element and/or kit name. If you would like to link to a website, please use the following link address: http://www.flergalicious.com
YOU MAY Copy my files to any external hard drives and computers that are owned and used expressly by you for digital scrapbooking purposes, this does not include computers that are used by other digital scrappers or people who would use my designs other than your immediate family (Spouse, Children living in the same household).
YOU MAY Make DVD or CD backups of my files to store solely for your own use. These backups may not be shared with any other person.

**YOU MAY NOT use my designs to make any products for sale or free, they are for your own personal use ONLY**
YOU MAY NOT claim these images as your own (altered or unaltered)
YOU MAY NOT redistribute our designs in any way (selling, sharing, loaning or pirating)
YOU MAY NOT create brushes or tubes from my designs
YOU MAY NOT use my designs for any harmful, pornographic, obscene, defamatory, immoral or racial material
YOU MAY NOT upload my designs to any webpage for download, send them through Google, Yahoo or other “list” groups
YOU MAY NOT Make “Quickpages” or templates from my designs and offer them for sale or free under any circumstances.

COMMERCIAL USE:

These terms of use apply to COMMERCIAL USE items purchased at SugarHillco & Sweet Shoppe Designs HERE

YOU MAY Create items for sale in digital kits which are for personal use & are also S4O/S4H friendly.

My products MUST BE altered for any type of usage- you may not sell them or give them as freebies in their original format. This includes, but is not limited to, styles, elements, brushes, overlays & shapes.

YOU MAY NOT use ANY styles or other products to make PU or CU styles for sale. E.G: Using Instabling styles to create a pack of PU or CU glitter styles.

YOU MAY NOT Resell my original files. They MUST be modified. They are a tool to be used for creation or items for digital kits, element packs, paper packs & alphas (packaged along with other elements) keeping in mind that my elements should not be the primary designs (not more than 30% of your designs per pack may be my commercial use items. You may not resell a pack of flowers using my CU flowers recoloured for example.)

YOU MAY NOT use these to create products you sell for Professional Use by other designers.

YOU MAY NOT include any of my CU products in layered templates for CU OR PU. Styles must not remain “active” and should be merged with another layer to flatten.

YOU MAY NOT use them to create actions, styles or PSP scripts & tubes.

YOU MAY NOT use them to create printed commercial products/paper lines for scrappers.

Do NOT share in Yahoo Groups, Rapidshare, Pando, 4Shared, demonoid etc…or any other file sharing group/website. Sharing is stealing and does NOT fall under the Fair Use Act.
